Terms of Service
1. Who we are
This website (miserviceprovider.co.za) is operated by Nexus Logic (Pty) Ltd (registration number 2026/756972/07), trading as Mi Service Provider ("we", "us", "our"). Our contact details, as required by section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), are set out in section 15 below.
2. Acceptance of these terms
By using the website you agree to these Terms of Service, our Privacy Policy and our POPIA Notice. If you do not agree, please do not use the website. Service providers who advertise with us are also bound by the terms of their advertising package; if those terms conflict with these, the package terms apply to the advertising relationship.
3. What the platform is, and is not
Mi Service Provider is an online advertising directory and community rating platform. Service providers pay to be displayed. Their position, rotation and duration are governed by the advertising package they buy.
We are not:
- a party to any quote, agreement, contract or transaction between you and a service provider;
- an employer, agent, partner or representative of any service provider;
- a guarantor of the quality, safety, legality, timeliness, pricing or outcome of any work.
Unless a listing expressly states otherwise, we do not verify a provider's qualifications, registrations, licences, insurance, tax status or identity. Phrases such as "preferred", "top", "trusted" or "as voted for by locals" describe how listings are presented on the site. They are not a warranty, endorsement or certification by us.
4. How listings are ordered
Listings shown for a town and service are paid advertising placements. We decide how many listings to accept for each category in each town. The order is random and changes every day at midnight, so that every listing gets a fair share of the first position. Ratings do not affect the order. A provider's score is the average of six star questions (response time, punctuality, fair price, quality of work, communication and payment ease), and is shown publicly from the provider's first rating, together with the number of ratings. Providers with no ratings yet are shown as "New on Mi Service Provider". Mi Service Provider does not rate providers. Ratings are the opinions of the people who submitted them, not ours. Providers may post one public response to each review. Responses are the provider's own words, not ours; they must be polite, factual and must not include personal information about the customer, and we may hide any response that does not meet these rules. Listings marked "Example" are samples that illustrate how the directory works and are not real businesses.
5. Your responsibilities when hiring a provider
Before you appoint any provider, you are responsible for satisfying yourself that they are suitable. We recommend that you:
- obtain a written quote and agree on scope, price and timelines in writing;
- ask for proof of any registration required for the work (for example, a PIRB-registered plumber or a registered electrician who can issue a Certificate of Compliance);
- ask whether the provider carries public liability insurance;
- avoid paying the full price before the work is done.
6. WhatsApp contact and reference codes
The WhatsApp button opens a chat in your own WhatsApp app, addressed directly to the provider's number, with a short pre-written message containing a reference code (for example, MSP-AB3CD). We do not send that message, cannot see it and do not monitor, record or take part in any conversation that follows. WhatsApp is a service of Meta Platforms and is governed by its own terms and privacy policy.
The reference code only tells the provider that you found them through Mi Service Provider. Any special offer, discount or benefit a provider extends to customers referred by us is made solely by that provider, and is honoured (or not) by that provider. We are not liable if a provider withdraws, changes or does not honour an offer.
7. Advertiser terms (service providers)
These terms apply to every business that applies for or holds a listing ("you" in this section). You accept them by ticking the acceptance box on the application form, which is a binding electronic acceptance under ECTA.
7.1 Independence
You are an independent business. Nothing creates employment, agency, partnership, joint venture, franchise or labour-broking between you and Nexus Logic (Pty) Ltd. You may not hold yourself out as acting for or on behalf of Mi Service Provider, and may refer to us only as "Listed on Mi Service Provider".
7.2 Payment for your services
We are not responsible for paying you for any service. We do not collect payment, act as a payment intermediary, chase debts, enforce quotes, or persuade any customer to accept a quote, complete a job or pay for any part of a transaction. All pricing, deposits, invoicing, collection and disputes are between you and your customer.
7.3 Slots
- A listing is advertising space for one business in one industry in one town or city ("a slot"), shown in up to three categories of that industry that you choose. We decide, at our discretion, how many listings to accept for each category in each town.
- You may only apply for a town or city in which your business is based or which it genuinely and regularly serves. Each additional town requires a separate application and a separate fee. We may ask for proof.
- Slots are allocated at our sole discretion. Applying does not guarantee a slot, and holding a slot gives no right to keep it or to be offered it again.
7.4 Fees and payment
- What you buy: one advertising slot for one industry in one town or city (shown in up to three categories of that industry), including customer ratings, public reviews, a provider login and a monthly performance report.
- Price: R295.00 per month per slot (one trade, one town).
- Free trial: a new listing approved on or before 31 December 2026 is free until 31 December 2026, and never for less than 14 days from the date it is approved. A listing approved from 1 January 2027 starts on a free trial of 14 days from the date it is approved. No card details are needed during the trial. Only one free trial is given per business per town: if your business (identified by its WhatsApp or contact number, email address, website or business name) has previously had a listing in the same town, the new listing is approved without a free trial and goes live only once your first payment has been received.
- Subscribing: we will remind you before your trial ends. To keep your listing, subscribe through our Paystack payment page before the trial ends. Your first monthly fee is charged when you subscribe, and that date becomes your monthly debit date. Fees are charged monthly in advance to the card you provide.
- Nexus Logic (Pty) Ltd is not VAT registered. Prices do not include VAT as we are not VAT registered, and the price quoted is the final price you pay.
- If you have not subscribed by the end of your free trial, your listing ends automatically and the slot may be given to another applicant. If your listing was approved without a free trial and you have not paid within 7 days of approval, the approval lapses. We do not accept late payment.
- If a monthly debit fails, Paystack will retry it. If payment is still not received 7 days after the failed debit, your listing ends automatically and the slot may be given to another applicant. To return, you must re-apply and a slot is not guaranteed.
- You may cancel at any time in your provider portal. You will not be debited again, and your listing stays live until the end of the month you have paid for.
- Fees are not refunded for partial months, or where a listing is removed because of your breach, misrepresentation or ratings.
- We may change fees on at least 30 days' notice. Paystack's own terms apply to payments processed through it.
7.5 Ratings
- Ratings come only from customers. Mi Service Provider and its staff do not rate providers and do not alter ratings, except to remove or discount ratings we reasonably believe are fraudulent, manipulated or unlawful.
- If your average rating falls to 3 stars or below, we will notify you so you can address it. If it falls to 2 stars or below, we may suspend or remove your listing.
- You may not rate yourself, pay or incentivise anyone to rate you, rate competitors, or pressure customers about their ratings. The email address in your application is blocked from rating your business, and we may remove ratings we reasonably believe come from you, your staff or a competitor.
- Customers who contact you through the website may rate your service. Ratings are powered by Service Sense, a product of Nexus Logic (Pty) Ltd, and are shown publicly on your listing.
- You cannot edit or delete ratings. You may flag a rating you believe is false, and the directors will review it. Ratings that are hidden after review are excluded from your score and reports.
- You will receive a monthly performance report by email, including an AI-drafted summary of your ratings and anonymous customer comments, and a login to view your own enquiries, ratings and reports. You will never be shown other providers' names or scores, or customers' contact details.
7.6 Vetting and removal
You consent to us checking publicly available information about your business and its owners, directors and members, including CIPC records, court records, consumer complaint platforms, online reviews, news and social media, both when you apply and while you are listed. We may decline an application, or suspend or remove a listing at any time, if we reasonably believe that you have breached these terms, have received credible complaints, or that your listing could harm or discredit Mi Service Provider, its users or its reputation. These decisions are made at our sole discretion and are final, to the extent permitted by law.
7.7 Your warranties
You warrant and undertake that:
- all information in your application and listing is true, complete and not misleading, and you will tell us promptly of any change;
- you hold every registration, licence, certificate and insurance legally required for your services, and will produce proof on request;
- you will comply with all applicable law, including the Consumer Protection Act 68 of 2008, POPIA, tax, labour and health and safety law, and the National Building Regulations where relevant;
- you will honour any offer you make to customers referred by Mi Service Provider;
- you will use customers' personal information only to respond to and serve them, as an independent responsible party under POPIA, and not for unsolicited marketing;
- you are solely responsible for your own work, workmanship guarantees, pricing, staff, sub-contractors, materials, tax and VAT.
7.8 No liability to you or for you
To the maximum extent permitted by law, we are not liable for any claim, loss or damage arising from your services or your dealings with customers or third parties, including damage to property, injury or death, theft, defective workmanship or materials, delays, disputes, non-payment, chargebacks or fraud by customers, acts of your staff or sub-contractors, permits and compliance certificates, tax, COIDA and labour matters, or data breaches on your systems. We are also not liable for any loss of income, profit, leads, enquiries, ratings or your slot, or for website downtime. A slot is advertising space and no number of leads, enquiries or jobs is guaranteed.
7.9 Indemnity
You indemnify Nexus Logic (Pty) Ltd and its directors, employees and agents against any claim, loss, liability, penalty or cost (including legal costs on the attorney-and-client scale) brought by a customer or anyone else, arising from your services, products, staff, sub-contractors, conduct, information you supplied, or breach of these terms.
7.10 Your content, intellectual property and legal compliance
You are solely responsible for everything you supply for your listing or publish in connection with it, including your business name, logo, images, descriptions, claims and offers ("your content"), and for making sure that it does not cross any legal line. We do not check your content for legal compliance and are not liable for it. In particular, you warrant that your content:
- does not infringe anyone's copyright, trade mark, design, business name or other intellectual property, and does not amount to passing off (for example, using a name or logo confusingly similar to another business);
- does not use the name, logo or accreditation mark of any brand, manufacturer, professional body or regulator (such as PIRB, the ECB or NHBRC) unless you are genuinely authorised or registered;
- is not false, misleading or deceptive, including under the Consumer Protection Act 68 of 2008 and the Code of Advertising Practice of the Advertising Regulatory Board;
- is not defamatory, discriminatory, hateful, obscene or otherwise unlawful, and does not disparage competitors;
- does not include images or personal information of any person without their consent, as required by POPIA.
You indemnify Nexus Logic (Pty) Ltd under clause 7.9 against any claim, demand, legal letter, takedown notice or proceedings arising from your content, including all legal costs on the attorney-and-client scale.
7.11 Complaints, legal notices, suspension and termination
- Notice to remedy: if we receive a complaint, a formal legal letter, a takedown notice (including under section 77 of ECTA) or any other credible notice that your content or conduct breaches these terms or the law, or if we otherwise become aware of a breach, we will notify you by email. You must remedy the breach within 7 days of our notice, or any longer period the law requires.
- Immediate suspension: we may suspend your listing (hide it from the website) immediately, without first giving notice, while a complaint or legal notice is being resolved, if we reasonably believe that continuing to display it may expose us or anyone else to legal liability or harm, or where a court, regulator or the law requires it.
- Termination: if you do not remedy the breach within the notice period, or if the breach is serious or cannot be remedied (such as fraud, dishonesty, a repeated breach, or conduct that could bring Mi Service Provider into disrepute), we may terminate your listing and this agreement with immediate effect by email.
- No refund: to the extent permitted by law, no fees are refunded for any period of suspension or after termination for breach, and you remain liable for any fees due up to termination. Your slot may be given to another applicant.
- Termination does not affect any rights or claims we have, including your indemnities, which survive termination.
8. Ratings and reviews
Browsing the website is open to everyone. Before you tap a provider's WhatsApp button or "Rate my Service", we ask for your email address and for your acceptance of these terms. Anyone who has dealt with a business may rate it. Each email address may rate a business once every 7 days, and a business may be rated once a day from the same device or connection. When you submit a rating you confirm that it reflects your genuine, first-hand experience, that you are not the provider or connected to the provider, and that it is not defamatory, abusive, discriminatory, false or unlawful. You grant us a non-exclusive, royalty-free, perpetual, worldwide licence to publish, display, edit for length or formatting, and remove your content in connection with the platform. You remain responsible for what you submit.
We may, but are not obliged to, moderate, edit or remove any rating or review, and may adjust or discount ratings we reasonably believe are fraudulent, manipulated or submitted in breach of these terms.
A provider who believes a review is false or unlawful may ask us to review it by emailing the address in section 15.
9. Acceptable use
You may not:
- copy, scrape, harvest or extract listings, contact details or ratings by automated or manual means for any commercial purpose;
- use provider contact details to send spam or unsolicited marketing;
- impersonate any person or business, or misrepresent your connection to a provider;
- interfere with the website's security or operation, or attempt to gain unauthorised access to it;
- use the website for any unlawful purpose.
10. Intellectual property
The Mi Service Provider name, logo, website design, layout and text (other than provider listings and user reviews) belong to Nexus Logic (Pty) Ltd or its licensors. You may not use them without our written permission. Providers warrant that they own or may use any name, logo or material they supply for their listing, and authorise us to display it. Providers alone are responsible for their content, as set out in clauses 7.10 and 7.11. If you believe content on the website infringes your rights, please email the address in section 15 with details of the content and your rights, and we will deal with it promptly.
11. Availability
We provide the website "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free or free of harmful components, or that any listing is accurate or current. We may change, suspend or discontinue any part of the website at any time.
12. Limitation of liability
To the maximum extent permitted by law, Nexus Logic (Pty) Ltd and its directors, employees and agents are not liable for any direct, indirect, incidental, special or consequential loss or damage arising from:
- your use of, or inability to use, the website;
- any service, work, product, quote, offer, act or omission of a service provider;
- any communication between you and a service provider;
- reliance on any listing, rating or review.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for gross negligence or wilful misconduct, or any right you have under the Consumer Protection Act 68 of 2008 that may not be excluded. Where our liability to a service provider cannot be excluded, it is limited to the advertising fees that provider paid us in the three months before the claim arose.
13. Indemnity
You indemnify Nexus Logic (Pty) Ltd and its directors, employees and agents against any claim, loss, liability or cost (including reasonable legal costs) arising from your breach of these terms, your content, or, if you are a service provider, your services and your dealings with customers.
14. General
- Changes: we may update these terms. The effective date above shows the current version. Continued use after a change means you accept it.
- Severability: if any provision is found invalid, the rest remains in force.
- No waiver: any leniency we show does not waive our rights.
- Governing law: these terms are governed by the law of the Republic of South Africa. You consent to the jurisdiction of the Magistrates' Court having jurisdiction over Nexus Logic (Pty) Ltd, despite the amount in dispute, without limiting our right to approach the High Court.
